Course Cancellation

Cancellation Circumstances: Courses may be canceled due to insufficient enrollment or instructor illness. In such cases, participants may opt for a full refund or reschedule for another available date.

Shipping

Delivery Options: Upon request, creations can be shipped via mail. Please note that we utilize suitable packaging materials, but we cannot guarantee against breakage or loss during transit. Additional charges may apply for incorrect shipping information or returned parcels.

Studio Atmosphere and Conduct

Respectful Environment: Our studio is intended to provide a serene environment conducive to creativity. We request that participants maintain a respectful demeanor, refraining from loud conversations or disruptive behavior. Smoking, eating, or computer use is prohibited within the studio premises.

Consequences of Misconduct: Any behavior deemed inappropriate or disrespectful towards fellow participants or staff may result in expulsion from the premises, with no refund provided for the workshop or course fee.

Usage Limitations: Gift cards are primarily valid for the specific workshop or course type selected upon purchase. Unused portions of the gift card cannot be refunded or transferred to other activities.

Expiration

Validity Period: All gift cards are valid for one year from the date of purchase. Bookings made after this period cannot be facilitated using the gift card. No discounts or refunds are available for expired gift cards.

Promotions

Ineligibility for Combining Promotions: Gift cards cannot be combined with any ongoing promotions or discounts.

Shipping

Global Delivery: Orders are processed and shipped within 3 business days of placement, using Swiss Post for worldwide delivery.

Shipping Details: Orders placed after 12 pm are processed from the following business day. Please note that the studio is closed on Sundays and Mondays, and these days are not counted in the processing time. To ensure timely delivery, it is advisable to place orders at least one week in advance.

Address Accuracy: The purchaser is responsible for providing the correct shipping address. In the event of re-shipping due to an incorrect address, an additional invoice of 5 CHF will be issued to cover handling costs while the shipping cost will be invoiced twice.

GENERAL TERMS & CONDITIONS 

 

Section 1 – Scope

 

These Terms and Conditions apply to all contracts entered into with Buba Studio, Zinnengasse 2, 8001 Zurich (“Buba Studio”). You acknowledge these terms and conditions in the version valid at the time of placing the order in the context of the order process.

 

Section 2 – Conclusion of Contract and Delivery of Products

 

2.1. All contracts concluded via www.bubastudio.com are entered into with Buba Studio. By clicking the "buy now" button, the customer makes a binding order. A binding contract is established when you receive the order confirmation.

 

2.2. The ordered products are delivered as soon as we have received the customer's full payment.

 

2.3. Delivery is contingent upon punctual and proper self-delivery by our suppliers. In the event of force majeure, such as strikes, riots, war, natural disasters, or blockages in delivery by manufacturers or subcontractors, there shall be no liability for delays in delivery. Buba Studio shall not be liable for delays caused by third parties.

 

2.4. If, after conclusion of the contract, products cannot be delivered partially or entirely for reasons beyond the control of Buba Studio, the customer is entitled to withdraw from the contract. In such cases, Buba Studio will refund any payments already made.

 

2.5. Buba Studio’s obligation is to send the products. This obligation is fulfilled upon handing over the ordered product to the transport company. After dispatch, the risk of accidental deterioration and loss of the product passes to the customer. Buba Studio is not responsible for faults of the transport company used.

 

Section 3 – Price, Customs Duties, and Shipping Costs

 

3.1. The prices quoted at the time the order is placed apply. The prices are final, including statutory VAT applicable at the time.

 

3.2. Shipping costs, customs duties, and any other costs incurred are not covered by Buba Studio and must be borne by the customer.

 

3.3. Please note that Swiss VAT is automatically deducted in the shopping cart when shipping outside Switzerland. However, local VAT and customs duties may apply upon receipt of the ordered product.

 

Section 4 – Payment

 

4.1. Buba Studio offers payment via credit card, PayPal, and other electronic payment methods. We reserve the right to refuse certain payment methods or direct customers to other payment options.

 

4.2. Any costs for money transfers are to be borne by the customer.

 

Section 5 – Returns

 

5.1. Buba Studio accepts returns for all purchased products within 14 days of purchase, provided that (i) the products are unused, in the same condition as received, and in original packaging, and (ii) the conditions in Section 5.3 are met.

 

5.2. To return a product, a return authorization is required. To receive a return authorization, please email onlineorders@bubastudio.com. Do not ship your products before receiving authorization.

 

5.3. Gift cards, sale items, swimwear, personalized items, and care products cannot be returned.

 

5.4. Shipping costs, customs duties, and any other costs for the return of the product are not covered by Buba Studio and must be paid by the customer.

 

5.5. Returns must be sent to: Buba Studio, Zinnengasse 2, 8001 Zurich. Returns are only accepted by post; in-store returns are not allowed.

 

Section 6 – Refunds

 

Refunds will be processed to the account used for payment after inspection of returned goods. You will be notified by email regarding the approval or rejection of your refund request. Shipping costs, customs duties, and any other incurred costs will not be refunded.

 

Section 7 – Warranties

 

7.1. You are required to check the delivered products as soon as feasible after receipt and inform Buba Studio within 5 business days of any defects by sending a picture of the defect to onlineorders@bubastudio.com. Failure to do so will result in the products being deemed approved.

 

7.2. Defects that could not be detected during the initial inspection must be reported immediately upon detection, along with a picture of the defect. Failure to notify will result in the product being deemed approved concerning those defects.

 

7.3. Buba Studio warrants to rectify defects at our discretion either by remedy (elimination of defect) or by delivering a defect-free item (replacement).

 

7.4. If the supplementary performance fails, the customer is entitled to withdraw from the contract, excluding insignificant defects. The customer's right to a reduction of the purchase price is excluded.

 

7.5. The warranty does not cover normal wear and tear, improper handling, damage by the buyer or third parties, or defects due to external circumstances.

 

7.6. Buba Studio does not provide a warranty of title.

 

Section 8 – Liability

 

Liability arising in connection with the sale or delivery of Buba Studio's products or use of this website is limited to the extent permitted by applicable law. The amount of a potential claim is limited to the purchase price of the sold product.

 

Buba Studio does not assume liability for descriptions of third parties, particularly customer reviews published on our website or social media.

 

Section 9 – Severability

 

Should individual provisions of this contract be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The ineffective provisions shall be replaced by the respective legal regulations.

 

Section 10 – Applicable Law and Jurisdiction

 

This Agreement and all legal relationships are governed by Swiss Law. The United Nations Convention for the International Sale of Goods (CISG) is not applicable. In consumer contracts, this choice of law applies only to the extent that protection granted by mandatory provisions of the law of the state in which the consumer has habitual residence is not withdrawn.

 

The courts of Zurich, Switzerland, have exclusive jurisdiction over any disputes related to this Agreement. In consumer contracts, the courts at the consumer's domicile in Switzerland have exclusive jurisdiction.

 

Section 11 – Changes to Terms and Conditions

 

Buba Studio reserves the right to change, update, or replace any part of these Terms and Conditions at any time without notification.
